The general Terms and Conditions of the online store Drogerija Bela determine the conditions for the sale of products in the online store www.drogerijebela.hr (hereinafter “online store”).
The owner of the online store is the company Drogerije Bela d.o.o. (hereinafter referred to as the “Seller”)
The General Terms and Conditions have been drafted in accordance with the Consumer Protection Act, the Companies Act, the Electronic Commerce Act, the Trade Act, the Civil Obligations Act, Regulation (EU) 2016/679 on Personal Data Protection, and other applicable regulations.

Terms of purchase
Purchase in the online store is currently only possible for persons located in the Republic of Croatia. Only persons over 18 years of age can order. The sale of alcoholic beverages to minors or persons under 18 years of age is prohibited.
Customers can choose from three offered products. You add the desired product to the cart by clicking on the “Add to cart” button. If you want to continue buying, you can click on the next product or select the quantities of the already selected product. The products you add to your cart will appear in the upper right corner of the cart icon. After the last addition of the product, click the “Proceed to checkout” button.
It is necessary to fill in all the information before buying. Fields marked with an (*) are required. Choose the method of payment and delivery. Please check the information and confirm your order. Upon confirmation of the order, you will receive a notification of the received order to your e-mail address.
Order validity / contract conclusion
The order becomes valid at the moment the customer sends the order. Ordered products are calculated at the prices published on the online store page at the time of sending orders.
In case of technical errors, at the time of sending the order on a working day, we will notify the customer of the errors within 24 hours. In case of technical errors, at the time of sending the order on Saturdays, Sundays and holidays, we will notify the customer of the errors no later than the next working day.
If the desired product is sold out, we will notify the customer within 24 hours or in the case of sending an order on Saturdays, Sundays or holidays, we will notify the customer no later than the next working day.
The quantity of ordered products is not limited to individual users.
Exhibiting a product on an online store is considered as an invitation to the customer to make an offer, and a customer order is considered as offer. The customer will receive a confirmation without delay that the seller has received his order via the e-mail address specified in the form. After processing the order, the seller will additionally confirm to the customer via e-mail that the offer has been accepted.
A contract is concluded between the seller and the customer at the moment when the seller confirms that he has accepted the offer.
After sending the order, the customer receives an electronic confirmation via e-mail, and when picking up the shipment, the customer receives an invoice / delivery note with the specification of the sent products.
All product information, including descriptions, specifications and prices, is displayed in the best of intentions and to describe the product as faithfully as possible to the customer. Product data is subject to technical and typographical errors and Internet bugs. In case of obvious data inaccuracies, the online store reserves the right to terminate the contract.
Prices are valid for all users of the online store. Prices are in HRK, and the approximate equivalent is shown in EUR. The prices below the product do not show value added tax (VAT), which is 25%. Before concluding the order, the total price is indicated in the cart (with and without VAT.)
Prices from the online store are valid exclusively for the online store.
Orders can be placed online at any time of the day or night, every day from 0 to 24 hours.
All orders received on a business day (Monday – Friday) will be processed immediately.
The buyer will place the order at least 7 days before the date of the desired delivery of the product. If the customer places an order in which desired delivery date is shorter than 7 days, we will do our best to complete the delivery, however we can not guarantee that we will be able to complete the delivery within the desired time.
Returns and replacements
In accordance with the Law on Consumer Protection, Article 72. paragraph 1, the customer has the right to unilateral termination of the contract, without giving reasons, within 14 days from the date of receipt of the ordered products.
In order to exercise the right to terminate the contract, the customer is obliged to notify the seller in writing of his intention, and return without delay unsealed and unused, ordered products at his own expense, and no later than 14 days after notifying the seller of termination. Returned products must be in good condition, unsealed, unused and in the original packaging. Otherwise, the costomer is liable for any impairment of the goods resulting from the handling of the goods, other than that which was necessary to determine the nature, characteristics and functionality of the goods.
The customer’s right to unilateral termination of the contract is excluded for the reasons prescribed by Art. 79 of the Consumer Protection Act, and especially if it is about:
• perishable goods or goods that expire quickly and
• sealed goods that are not suitable for return due to hygienic or health reasons, and if they were unsealed after delivery
The customer may send a written notice of intent to terminate the contract unilaterally:

In case of incorrectly delivered, the customer is entitled to a replacement or refund. In order to exercise the right to replace or return the product, the customer is obliged within 8 days from the date of receipt of the product, notify the seller by phone or e-mail, and agree to pick up and replace incorrectly delivered products.
The costs of returning and / or replacing incorrectly delivered or defective products shall be borne by the seller. In case of replacement of incorrectly delivered products, returned products must be in good condition, unsealed, unused and in the original packaging.
In the case of delivery of products with a material defect, the provisions of the Civil Obligations Act, which regulate the seller’s liability for material defects (Articles 400 to 422 of the Act), apply. In the event that the seller gives a guarantee for the correctness of the sold item (warranty), the guarantee does not diminish the rights of the customer based on the seller’s liability for material defects.
In the event of a defect, of which the seller is notified in a timely and correct manner, the customer may request the seller to refund the amount paid or replace the products with new ones within 14 days from the date of notification of the error and return of the product.
In the event that, when picking up the product, the customer finds that the package is physically damaged or shows signs of opening, the customer should refuse to pick up the package.
Resolving consumer disputes
Article 14 (1) of Regulation of the European Union no. 524/2013. The Online Dispute Resolution platform obliges retailers based in the European Union participating in online sales contracts to provide an electronic link to the ORS Platform in an easily accessible place on their website. The Online Consumer Dispute Resolution Platform (ORS Platform) became operational on February 15th, 2016.

The seller is not currently participating in the respective consumer dispute resolution procedures.
In the event of a dispute between the customer and the seller, it is possible to file a complaint with the Court of Honor of the Croatian Chamber of Commerce, and the proceedings before the Court are conducted in accordance with the Ordinance on the Court of Honor at the Croatian Chamber of Commerce.
